These Terms and Conditions (“Terms”) govern your use of the James Noble Services website and the coaching services provided by James Noble Services (“we,” “our,” or “us”). By accessing our website or engaging our services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you must not use our services.

1. Service Agreement

1.1 Nature of Services

James Noble Services provides coaching services in the areas of Offenders Support, Parenting Support, Confidence-Boosting, and General Life Coaching. Our services are not a substitute for professional psychological, legal, medical, financial, or other professional advice, diagnosis, or treatment.

1.2 Client Responsibilities

As a client, you are responsible for:

  • Providing accurate and complete information
  • Actively participating in the coaching process
  • Completing agreed-upon activities between sessions
  • Making independent decisions regarding your life and taking responsibility for those decisions
  • Notifying us if you feel the coaching is not meeting your needs

1.3 Session Attendance

You agree to attend scheduled sessions promptly. Our time is reserved exclusively for you during your appointment slot.

2. Payment and Cancellation Policies

2.1 Payment Terms

  • All payments must be made in advance of services
  • Prices are clearly displayed on our website and in your service agreement
  • We accept major credit cards and electronic payments through our secure payment system
  • Pricing is subject to change, but you will be notified of any changes

2.2 Cancellation Policy

  • 48+ hours notice: Full refund or session rescheduling
  • 24-48 hours notice: 50% refund or session rescheduling with $25 fee
  • Less than 24 hours notice: No refund (except in genuine emergencies at our discretion)
  • We reserve the right to cancel or reschedule sessions with 24 hours notice

2.3 Refund Policy

  • If you’re unsatisfied with your first paid session, we offer a 100% refund if requested within 24 hours of the session
  • Package purchases (e.g., 7-week or 12-week programs) are non-refundable after the second session
  • If we determine we cannot provide the service you need, we will refund any unused session fees

3. Confidentiality and Privacy

3.1 Confidentiality Commitment

We maintain strict confidentiality regarding all client communications and information. Details of our privacy practices can be found in our Privacy Policy.

3.2 Limitations to Confidentiality

Confidentiality may be broken in the following circumstances:

  • If required by law or court order
  • If there is a threat of serious harm to yourself or others
  • In cases of suspected child or elder abuse
  • If you disclose the intent to commit a crime

3.3 Session Recording

Sessions are not recorded unless explicitly agreed upon in writing by both parties for specific coaching purposes.

4. Communication Policies

4.1 Between-Session Communication

  • Email support is available between sessions with a 48-hour response time
  • Emergency situations should be directed to appropriate emergency services, not to your coach
  • Excessive between-session communication may result in additional charges

4.2 Electronic Communication

  • Email and text communications are not guaranteed to be secure or confidential
  • Sensitive information should be discussed during sessions rather than via email
  • We are not responsible for breaches of confidentiality caused by unsecured or unauthorized access to electronic communications

5. Termination of Services

5.1 Termination by Client

You may discontinue services at any time. We request that you provide notice of your intention to terminate services to allow for proper closure.

5.2 Termination by Coach

We reserve the right to terminate services if:

  • You breach these Terms
  • We determine our services are not beneficial to you
  • You are consistently late or miss scheduled appointments
  • You exhibit abusive or inappropriate behavior
  • Payment is not received according to the agreed terms

5.3 Unused Sessions

For pre-paid package clients, unused sessions remaining after termination may be refundable on a prorated basis, less a $50 administrative fee, at our discretion.

6. Intellectual Property

6.1 Ownership of Materials

All materials provided during coaching sessions, including worksheets, exercises, and proprietary methodologies, are the intellectual property of James Noble Services and are protected by copyright laws.

6.2 Personal Use Only

Materials are provided for your personal use only and may not be reproduced, distributed, or used for commercial purposes without our express written consent.

7. Limitation of Liability

7.1 Results Not Guaranteed

While we are committed to providing quality coaching services, we cannot guarantee specific results. Success depends on various factors, including your commitment, circumstances, and implementation.

7.2 Liability Cap

Our liability for any claim arising from our services is limited to the amount you paid for the services directly related to the claim.

7.3 Indemnification

You agree to indemnify and hold harmless James Noble Services, its employees, and agents from any claims, liabilities, or expenses arising from your use of our services or violation of these Terms.

8. Governing Law and Dispute Resolution

8.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [State], without regard to its conflict of law provisions.

8.2 Dispute Resolution
